According to Deputy Tim Jackson’s Uniform Citation, at 4:52 p.m. (1652 hours) he observed Mr. Fleming traveling 13 mph over the posted speed limit using a dash-mounted radar unit. The citation further states that Mr. Fleming was placed under arrest at 4:55 p.m. (1655 hours). The citation lists both the alleged traffic violation and the arrest as occurring on Caneyville Road in Edmonson County.

However, video evidence obtained from Roundhill Market appears inconsistent with portions of Deputy Jackson’s written narrative.

In his report, Deputy Jackson states that he immediately turned around on Caneyville Road after observing Mr. Fleming speeding and continued observing him until initiating a traffic stop. He further wrote that Mr. Fleming pulled into the Roundhill Market parking lot before fleeing into Butler County.

The available surveillance footage does not appear to support that sequence of events. Instead, the video shows Deputy Jackson arriving at Roundhill Market from Kentucky Highway 70, not Kentucky Highway 185 (Caneyville Road), approximately four minutes after Mr. Fleming had already arrived at the store. At no point does Deputy Jackson appear on camera entering the parking lot from Caneyville Road.

The footage shows Deputy Jackson remaining in the parking lot for several minutes while observing Mr. Fleming before leaving northbound on Highway 185. After Deputy Jackson leaves the area, Mr. Fleming exits the parking lot, travels westbound on Highway 70, stops at the posted stop sign, and appears to continue at or near the posted speed limit before leaving the camera’s view.

Moments later, Deputy Jackson is seen traveling southbound on Highway 185 at a high rate of speed. The video appears to show him failing to stop at the stop sign before turning right onto Highway 70 and accelerating toward Mr. Fleming. The traffic stop ultimately occurs just before Threlkel Cemetery Road on Highway 70 in Butler County, approximately one mile from Roundhill Market.

Based on the available surveillance footage, the video does not appear to corroborate Deputy Jackson’s written statements that:

  • Mr. Fleming was first observed speeding on Caneyville Road.
  • Deputy Jackson immediately turned around after observing the alleged speeding violation.
  • Mr. Fleming fled, “ran,” or attempted to “dip” Deputy Jackson.
  • The stated probable cause for the stop occurred as described in the citation.
  • Deputy Jackson was lawfully operating within his jurisdiction at the time the events unfolded.

According to the reporting party, Edmonson County Sheriff James Vincent was notified of the incident on October 16, 2023, but no internal investigation was initiated. The reporting party further alleges that Deputy Jackson has been the subject of multiple complaints involving law enforcement activity outside his jurisdiction.

Mr. Fleming arrives at Roundhill Market in a tan Chevrolet Blazer traveling southbound on KY 185 and enters the store after parking at the gas pumps.

3:18 p.m.
Mr. Fleming begins pumping fuel.

3:19 p.m. (Camera 3)
Deputy Tim Jackson is observed traveling westbound on KY 70 toward the intersection of KY 70 and KY 185. He turns right onto KY 185, immediately cuts through the neighboring business parking lot, crosses KY 70, and enters the Roundhill Market parking lot.

3:20 p.m. (Camera 2)
Deputy Jackson parks and remains in the lot while observing Mr. Fleming for several minutes.

3:24 p.m. (Cameras 2 & 3)
Deputy Jackson exits the parking lot traveling northbound on KY 185. After allowing Deputy Jackson to leave the immediate area, Mr. Fleming exits the parking lot traveling westbound on KY 70. Deputy Jackson is then seen turning around, allegedly disregarding the stop sign, and accelerating at a high rate of speed before catching up to Mr. Fleming. The traffic stop occurs in Butler County.
